Introduction
Welcome to Motrify, an online store specializing in automotive accessories and related electronic devices. The store operates through an e-commerce platform utilizing a global direct fulfillment model supported by authorized international distribution centers and specialized fulfillment partners, targeting customers in the United Arab Emirates and the Gulf Cooperation Council (GCC) countries.
These Terms and Conditions, together with the related policies, are established to regulate the legal relationship between Motrify and its users, define the rights and obligations of each party, and provide a clear legal framework governing purchases, payments, shipping, returns, refunds, and warranty matters, in accordance with the applicable laws of the United Arab Emirates and recognized e-commerce best practices.
By accessing the store or placing any order, the user acknowledges and agrees to be bound by these Terms and Conditions and all associated policies, including the Shipping Policy, Return and Refund Policy, and Privacy Policy. The user also acknowledges the operational nature of the store under the Dropshipping model and the potential variations in shipping origin, packaging, and delivery timelines depending on logistical conditions.
Motrify reserves the right to amend these Terms and Conditions and related policies at any time. Continued use of the store following the publication of any updates shall constitute acceptance of such amendments.
1. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings assigned to them below, unless the context requires otherwise:
"Store", "Motrify", "we", "us", or "our" means the Motrify online store for automotive accessories.
"Customer" or "User" means any person accessing the website or placing an order.
"Products" means all goods offered for sale through the store.
"Order" means a purchase transaction completed through the store.
"Supplier" means a third-party provider or authorized distribution center through which orders are fulfilled and products are shipped directly to the customer under Motrify’s global direct fulfillment model.
"Store Credit" means a voucher or credit balance redeemable exclusively within the store.
2. Acceptance of Terms
By using the store or placing an order, the user acknowledges that they have read, understood, and agreed to these Terms and Conditions in full. Such acceptance shall be legally binding and shall extend to all policies referenced herein or published on the store.
3. Eligibility and Registration
The user acknowledges that the use of Motrify and the placement of orders through the store are limited to individuals who possess the legal capacity to enter into binding contracts under the applicable laws of their country of residence. By using the store, the user confirms that they have reached the legal age required to make purchases and accept full legal responsibility for any order placed.
The user further agrees to provide accurate, complete, and up-to-date information when placing an order or creating an account, including name, phone number, and shipping address. Providing inaccurate or misleading information shall constitute a violation of these Terms, and the store reserves the right to suspend or cancel the order accordingly.
Motrify reserves the right to refuse or suspend any account or order where eligibility requirements are not met, where unlawful use is suspected, or where inaccurate information is provided, without obligation to provide reasons.
The store may also conduct verification procedures it deems appropriate to confirm user identity, data accuracy, or transaction validity. Continued use of the store constitutes the user's express consent to such verification procedures.
4. Nature of Store Operations
The customer acknowledges that Motrify operates under a global direct fulfillment model through authorized international distribution centers and specialized fulfillment partners. Accordingly, products may be shipped directly to the customer from different fulfillment locations depending on product availability and logistical considerations. As a result, shipping origins, packaging, and processing timelines may vary based on the designated fulfillment center or authorized fulfillment partner.
The customer further agrees that:
ü Shipping may originate from outside the United Arab Emirates
ü Product packaging may vary depending on the supplier
ü Orders may be fulfilled in multiple separate shipments
ü Delivery timelines may vary depending on logistical conditions
Such variations shall not constitute a breach by Motrify, provided that the product delivered is consistent with the description provided at the time of purchase.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Motrify’s liability for any claim, damage, or loss arising out of or related to the use of the website or the purchase or use of any products shall be strictly limited to the amount paid by the customer for the relevant order. Under no circumstances shall Motrify be liable for any direct, indirect, incidental, consequential, special, or economic damages, including, without limitation:
ü Improper installation or incorrect mounting of products
ü Incompatibility with a specific vehicle or electrical system
ü Electrical or technical malfunctions resulting from installation or use
ü Misuse or use contrary to instructions
ü Commercial or professional use of the products
ü Any modification, disassembly, or reinstallation of the product
ü Damage occurring after delivery
ü Delays in shipping or delivery
ü Loss of use or vehicle downtime
ü Loss of profits or any indirect or consequential damages
ü Damages resulting from reliance on or use of the product
The customer further acknowledges that the products offered are automotive electronic accessories, and that installation or use may require technical knowledge. The customer assumes full responsibility for ensuring compatibility with their vehicle and proper use of the product.
The customer expressly agrees that all products are used at their own risk, and that Motrify shall bear no liability exceeding the value of the purchased product.
6. Warranty
Motrify provides a limited warranty strictly covering manufacturing defects in the products, including defects arising from faults in materials or workmanship, in accordance with the nature of each product and as specified on the product page.
This warranty does not cover any damages or issues arising from causes outside the scope of manufacturing defects, including, without limitation:
ü Misuse or use contrary to instructions
ü Improper installation or incorrect electrical connection
ü Damage caused by the customer after delivery
ü Use of the product for unintended purposes
ü Damage resulting from accidents or external factors
ü Normal wear and tear from use
ü Opening, modifying, or repairing the product by unauthorized parties
ü Any alteration to product components or accessories
Determination of whether a defect qualifies as a manufacturing defect shall be subject to technical inspection by Motrify or the authorized supplier, and the outcome of such inspection shall be final.
7. Electronic Automotive Products Disclaimer
The customer acknowledges that certain products offered by Motrify constitute electronic accessories or electrical devices intended for use in vehicles, which may require technical compatibility with the specific vehicle or its electrical system.
Accordingly, the customer is responsible for ensuring that the product is suitable for their vehicle and for using the product in accordance with the provided instructions. The customer also assumes full responsibility for installation, usage, and any technical or electrical connections performed after delivery.
Motrify shall not be liable for any malfunctions, damages, or losses resulting from technical incompatibility, improper installation, incorrect electrical connection, misuse, or any technical intervention performed after delivery.
Use of such products after delivery shall constitute the customer’s acknowledgment of suitability for their intended purpose and acceptance of full responsibility for installation and operation, without any technical or operational liability on the part of Motrify.
8. Pricing and Payments
Product prices displayed on the Motrify store are shown in the currency indicated on the website and reflect the product value only, unless expressly stated otherwise.
Value Added Tax (VAT) and any applicable fees are calculated and added at the final checkout page prior to completing the order. The customer agrees that the total amount displayed at checkout constitutes the final payable amount for the order.
Payments are accepted exclusively through electronic payment methods available on the store via third-party payment gateways. The use of such payment methods is subject to the terms and conditions of the respective payment providers. Motrify shall not be responsible for any additional charges imposed by banks, payment processors, or card issuers, including currency conversion fees, international transaction fees, or other related charges.
Motrify reserves the right to modify product prices at any time without prior notice. However, such changes shall not affect orders that have already been confirmed. No retroactive adjustments shall apply to completed transactions.
In the event of a technical or administrative pricing error, Motrify reserves the right to cancel the order or correct the price after notifying the customer, with a full refund of any amounts collected, where applicable.
Completion of payment constitutes the customer’s authorization for Motrify to charge the order amount and serves as final confirmation of the order. The customer may not subsequently dispute the order on the basis of pricing, taxes, or fees disclosed prior to payment.
9. Order Cancellation
Motrify reserves the right to cancel any order, prior to shipment or thereafter where necessary, for legitimate reasons relating to transaction security or the feasibility of order fulfillment. In such cases, Motrify’s obligation shall be limited to refunding any amounts paid, where applicable.
This includes, without limitation, situations where the product becomes unavailable, suspected fraudulent activity is detected, payment methods appear unauthorized, shipping details are inaccurate or incomplete, payment authorization is declined, orders are deemed unusual in nature or quantity, or misuse of store policies is identified.
Where an order is canceled, Motrify will notify the customer and process any applicable refund using the original payment method or an alternative method deemed appropriate by the store.
10. Shipping and Delays
The customer acknowledges that shipping and delivery services are performed by third-party logistics providers and that delivery timelines are estimates subject to change based on operational and logistical conditions related to shipping and supply chains. Accordingly, Motrify shall not be liable for any delay in delivery arising from circumstances beyond its reasonable control.
Such circumstances include, without limitation, delays caused by shipping carriers, customs clearance and inspection procedures, logistical constraints, peak seasons, public holidays, exceptional conditions, force majeure events, or any other circumstances beyond the store’s control.
The customer agrees that delays resulting from such circumstances shall not constitute a breach of Motrify’s obligations and shall not give rise to compensation or liability. However, Motrify may, at its discretion, provide appropriate solutions to maintain customer satisfaction.
11. Intellectual Property
All content available on the Motrify store, including but not limited to text, designs, logos, images, product descriptions, graphics, visual elements, website structure, and any other materials published on the store, are owned by Motrify or licensed to it, and are protected under applicable intellectual property laws.
No part of the store content may be copied, reproduced, modified, distributed, or used for any commercial or non-commercial purpose without prior written consent from Motrify. The use of the store name, trademarks, or content in a manner that may cause confusion or imply endorsement, affiliation, or partnership without explicit authorization is strictly prohibited.
12. Dispute Resolution
The parties agree to first attempt to resolve any dispute or claim arising from the use of the Motrify store or any transactions conducted through it amicably by contacting customer support prior to initiating any legal proceedings.
If an amicable resolution cannot be reached, these Terms and Conditions and all transactions conducted through Motrify shall be governed by and construed in accordance with the laws of the United Arab Emirates.
The user expressly agrees that the courts of the United Arab Emirates shall have exclusive jurisdiction to hear and determine any dispute, claim, or controversy arising out of or relating to the use of the store or the purchase of products. No legal action or claim may be brought against Motrify before any court outside the United Arab Emirates.
The user further acknowledges that any claim or legal proceeding filed outside the specified jurisdiction shall be deemed invalid to the fullest extent permitted by applicable law.
